The American legal system is rooted in English common law and a Constitution drafted in a very different historical, political, and social context than the one that exists today. As legal scholars increasingly reevaluate the assumptions underlying American law's most crucial precedents, they face a tension between adapting the law to contemporary understandings of justice and remaining faithful to the Founders' original intent. To what extent can and should American law and legal theory move beyond its origins while remaining consistent with the Constitution and common law tradition?
